Participants in the pilot will be able to access a service that will attempt to shorten the time it takes to resolve disputes and provide resolution at an earlier stage in the process. The scheme will run over the course of the next 12 months (ending on March 31, 2023) and existing NRLA members will be able to opt in.
Landlords signing up for the scheme will not be charged for their participation, while it will also be free for tenants during this period. However, it is anticipated that should the scheme become compulsory at a later date, landlords will need to pay a modest fee to join.
The Department for Levelling Up, Housing & Communities (DLUHC) had previously announced that legislation would be introduced to make it mandatory for all private landlords to be part of a redress scheme. While a redress scheme has existed since 2014, if the forthcoming pilot scheme is successful, being part of such a scheme could become a legal requirement.
How does the redress scheme benefit landlords and residents?
If a tenant has a complaint they want to be addressed, it can be put forward to the new independent scheme. A case assessor will be assigned to review the complaint and encourage early resolution or arrive at a decision that provides a fair outcome for a broad scope of tenancy issues.
The scheme ensures there is a clear and transparent procedure that can be followed, so tenancy-related issues can be aired and fairly resolved, hopefully to satisfaction of both parties.
By using this format, it should mean fewer disputes end up in court, as legal proceedings often become drawn out and a costly exercise for landlords and tenants. Going to court over a tenancy dispute rarely benefits anyone involved and the new redress scheme will make it easier to reach a fair resolution by encouraging dialogue between everyone involved.
In summary, you can benefit from signing up to the pilot property redress scheme because it is:
